03 WHAT ARE COOKIES?
Cookies are small files that a website may store in a user’s browser or device when the user visits it. They can remember information, support technical functions, retain preferences and, when authorized by the user, provide statistical information or support measurement and marketing activities.
Similar technologies may also be used, such as tags, pixels, scripts, local storage, or other mechanisms that recognize a browser or device and process information related to site use.
04 APPLICABLE FRAMEWORK
When the use of cookies or similar technologies involves processing personal data, ARCA will apply the principles and obligations established in Law 1581 of 2012, its implementing rules incorporated in Decree 1074 of 2015, and other applicable Colombian data-protection provisions.
In particular, ARCA will seek to ensure that processing follows the principles of lawfulness, purpose, freedom, transparency, restricted access and circulation, security, and confidentiality.
When a visitor is in a jurisdiction recognizing additional privacy and data-protection rights, ARCA will meet the obligations applicable to the nature of the processing and the territorial scope of the relevant law.
05 COOKIE CATEGORIES
5.1. Functional cookies
They are necessary for basic operation, security, and the proper provision of the website’s services.
They may be used, among other purposes, to:
- maintain essential site functions;
- protect forms and communications against misuse;
- remember the user’s consent decision;
- retain settings essential for navigation;
- ensure technical stability, availability, and security.
These cookies may operate without additional authorization when strictly necessary to provide a user-requested function or ensure site operation.
5.2. Preference cookies
They remember choices made by the user to provide a more consistent experience, such as certain display, language, or site-behavior settings.
When they are not strictly necessary, they will be activated only with the corresponding authorization.
5.3. Statistics cookies
They make it possible to understand, in aggregated or individualized form, how the website is used, for example:
- pages visited;
- approximate session duration;
- general source of the visit;
- device or browser type;
- interactions with content and forms;
- technical errors or site performance.
ARCA uses this information to assess site performance, identify improvement opportunities, and understand the use of its digital content and services.
Non-essential statistics cookies will be activated only when the user gives consent.
5.4. Marketing cookies
They may be used to measure campaigns, analyze interactions with promotional content, limit ad repetition, or assess the effectiveness of communication and digital-positioning activities.
These technologies may be operated by ARCA or by authorized external providers such as analytics, advertising, or social-media platforms.
Non-essential marketing cookies will be activated only when the user gives consent.
06 FIRST-PARTY AND THIRD-PARTY COOKIES
First-party cookies are managed directly from ARCA’s domain.
Third-party cookies are set or managed by external providers whose services may be integrated into the site, such as measurement, analytics, security, content, typography, social media, or advertising tools.
Depending on the site configuration and the authorizations granted by the user, services that may be involved include tools related to Google and Meta/Facebook.
Each third party is responsible for its own privacy terms and practices. Non-essential services will be activated according to the category selected by the user and ARCA’s consent-system configuration.
The presence of a provider in this section does not mean that all of its technologies are permanently active or operate without consent.
07 INFORMATION THAT MAY BE COLLECTED
Depending on the technology used and the authorized preferences, cookies may collect or generate information such as:
- technical browser or device identifiers;
- IP address;
- device type, operating system, and browser;
- date and time of access;
- pages visited and browsing duration;
- interactions with buttons, links, content, or forms;
- general source or channel of arrival at the website;
- approximate location information derived from the IP address;
- consent preferences;
- campaign measurement and attribution data.
ARCA will not use cookies to access files stored on the user’s device or to obtain information unrelated to browsing and the stated purposes.
08 CONSENT AND PREFERENCE MANAGEMENT
When first entering the site, the user may:
- accept all enabled categories;
- reject non-essential cookies;
- review the available categories;
- select preferences;
- save a custom configuration.
Strictly necessary functional cookies will remain active when they are essential to operate the site or retain the user’s decision.
Preference, statistics, and marketing categories will remain disabled until the user gives authorization, where applicable.
El usuario puede cambiar o retirar su consentimiento en cualquier momento mediante la opción “Manage consent”, disponible de forma persistente en el sitio web.
Withdrawing consent does not affect the lawfulness of processing carried out before that decision.
09 DURATION
Cookies may be:
- session cookies: deleted or deactivated when the browser is closed;
- persistent cookies: retained for a specific period or until the user deletes them;
- consent cookies: temporarily retain the user’s decision so it does not have to be requested on every visit.
Duration depends on the purpose, the technical configuration, and, for third-party cookies, the terms established by the relevant provider.
The current technical inventory should indicate, when available, the name, provider, purpose, category, and duration of each detected cookie or technology.
10 COOKIE AND SERVICE INVENTORY
ARCA maintains a process for identifying and reviewing the cookies and services used on its website.
The technical inventory may be updated when:
- features are added or removed;
- technology providers change;
- new cookies are detected;
- purposes or durations are modified;
- the site configuration is updated.
Technical inventory changes that do not substantially alter the processing purposes may be reflected without replacing this policy in full.
